License agreement

IMPORTANT NOTICE - READ CAREFULLY: This License for Consumer Use of the BrainyCP Software ("LICENSE") is an agreement governing the use of BrainyCP software, which can be downloaded from https://brainycp.io, http://core.brainycp.com , including computer software and related printed materials ("SOFTWARE"). By downloading, installing, copying or otherwise using the SOFTWARE, you accept the terms of this LICENSE. If you do not agree to the terms of the LICENSE, do not download the SOFTWARE.

DECLARATION

The SOFTWARE is protected by copyright laws and international copyright treaties, and other intellectual property laws and treaties. The SOFTWARE is not sold, but only licensed for use, strictly in accordance with this document. This LICENSE establishes only the terms of the SOFTWARE LICENSE.

  1. DEFINITIONS

1.1 Consumer. Consumer means the entity or individual who downloads the SOFTWARE.

  1. ISSUANCE OF A LICENSE

2.1.1 Restrictions.

Engineering Analysis Exception. Consumer may not reverse engineer, decompile or disassemble the SOFTWARE or make any attempt to discover the source code.

The SOFTWARE is licensed as a single product. Its components may not be separated for use on multiple computers or used separately from each other for any other purpose.

  1. EXPIRY

This LICENSE will automatically terminate if the Consumer violates any of the above conditions. In such event, Consumer must destroy all copies of the SOFTWARE and all of its components.

Suspension for protective purposes. If a Consumer becomes involved in any legal proceedings against BrainyCP, BrainyCP may, in its sole discretion, suspend or terminate the license or other rights associated with this LICENSE while such legal proceedings are pending.

  1. COPYRIGHT

All titles and copyrights of the SOFTWARE (including but not limited to all images, photographs, animations, videos, audio, music, texts and other information included in the SOFTWARE), accompanying printed materials and all copies of the SOFTWARE belong to BrainyCP or its suppliers. The SOFTWARE is protected by the terms of copyright laws and international treaties. Accordingly, Customer must treat the SOFTWARE as any other copyrighted material, except as provided in this LICENSE, one backup or archival copy of the SOFTWARE.

  1. DISCLAIMER AND LIMITATION OF LIABILITY

5.1 No Guarantees. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND BrainyCP AND ITS SUPPLIERS DISCLAIMS ALL warranties relating to the market value of the Program, User satisfaction, or fitness for a particular purpose. The User is responsible for all risks associated with loss of profits, loss of data and errors arising from the possession or use of the Program.

5.2 No Liability for Indirect Losses. To the maximum extent permitted by the applicable law, in no case, the company BRANYCP or its suppliers are responsible for any special, random, direct or indirect losses (including, without restriction, income loss, business intervention, loss of business information or other monetary cash DAMAGES) ARISING FROM THE USE OF OR FAILURE TO USE THE SOFTWARE, EVEN IF BrainyCP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  1. DIFFERENT

If any term (provision) of this LICENSE does not comply with the law or cannot operate in full force under it, such term (provision) will be considered limited to the extent that it complies with the law and has the force under this law. This LICENSE is the final, complete and exclusive agreement between the parties associated with the subject matter and supersedes all prior and present written or oral understandings and agreements relating to the subject matter.
